Terms of Service

1. Introduction

Welcome to FlecBase, a cloud-based customer relationship management and field data platform operated by WebGen Services Pty Ltd (ABN: 35 650 143 561). These Terms of Service ("Terms") govern your access to and use of the FlecBase platform, including all associated websites, applications, and services.

2. Acceptance of Terms

By creating an account or accessing the FlecBase platform, you agree to be bound by these Terms. If you are using FlecBase on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms. If you do not agree, you must not use the platform.

3. Account Registration

To use FlecBase, you must create an account with a valid email address and secure password. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised access.

4. Subscription & Billing

FlecBase offers a free trial period followed by paid subscription plans. Subscriptions are billed monthly via Stripe. By subscribing, you authorise us to charge your designated payment method. All fees are in Australian Dollars (AUD) and are exclusive of GST unless stated otherwise. Refunds are handled in accordance with Australian Consumer Law.

5. Acceptable Use

You agree to use FlecBase only for lawful purposes and in accordance with these Terms. You must not: upload malicious content, attempt to gain unauthorised access to our systems, use the platform to store or transmit content that infringes intellectual property rights, or use the platform in any manner that could damage, disable, or impair our services.

6. Data & Privacy

Your use of FlecBase is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. You retain ownership of all data you upload to FlecBase. We will not access your data except as necessary to provide the service, comply with law, or as described in our Privacy Policy.

7. Intellectual Property

FlecBase and its original content, features, and functionality are owned by WebGen Services Pty Ltd and are protected by Australian and international copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the platform for the duration of your subscription.

8. Limitation of Liability

To the maximum extent permitted by Australian law, FlecBase and WebGen Services Pty Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities. Our total liability shall not exceed the amount you have paid us in the twelve months preceding the claim. Nothing in these Terms excludes or limits liability that cannot be excluded under Australian Consumer Law.

9. Termination

You may cancel your subscription at any time through the billing settings in your account. We may suspend or terminate your access if you breach these Terms. Upon termination, your right to use the platform ceases immediately. We will retain your data for 30 days after termination, after which it may be permanently deleted.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the platform. Your continued use of FlecBase after changes are posted constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of Queensland, Australia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Queensland, Australia.
